Client found NOT GUILTY of First Degree Murder.

Client faced a life sentence for the indicated charge of Murder in the First Degree.  After a jury trial, Client was acquitted of first degree murder and unlawfully being in possession of a firearm and was only found guilty of the lesser included offenses of Attempted Assault Second Degree and Conspiracy Second Degree and only received a 4 year sentence of incarceration.

Client's felony conviction successfully overturned on direct appeal, resulting in a new trial ordered by the Delaware Supreme Court. However, Counsel filed a motion to bar the new trial due to double jeopardy causing the AG Office to dismiss the case. Thus, NO conviction for client.

After a jury trial performed by another lawyer, Client was convicted of Aggravated Possession, Criminal Impersonation, and Possession of Marijuana.  On direct appeal, Client's conviction overturned by the Delaware Supreme Court agreeing with Counsel's argument that trial counsel rendered ineffective assistance of counsel due to a conflict of interest.  On remand, Counsel moved to bar re-trial on the grounds of double jeopardy and the State declined to continue the litigation and dismissed the charges.  Thus, TWO victories in this case.

Counsel successfully avoids possible trademark infringement litigation against client.

 

Local business received notice from legal counsel of a multi-national corporation of trademark infringement and was seeking damages and cessation of use of the trademark.  Counsel negotiated, on behalf of client, a stipulated resolution in which client did not have pay any damages and only had to discontinue use of the trademark which included the destruction of a small amount of items used in client's business which bore the trademark.

Counsel successfully obtained a sign variance for client's property.

Client retained Counsel to obtain sign variance for a property in which previous owners were twice previously rejected by the New Castle County Board of Adjustment in two hearings prior to being represented by Counsel.  The Board of Adjustment GRANTED the sign variance based on arguments and evidence provided by Counsel.

New Castle County agrees to major reduction of Client's sewer bills.

 

In an unprecedented type of matter, Counsel was able to obtain $132,230.70 reduction of Client's sewer bills as New Castle County agreed that a water leak led to excessive billing.
