FEDERAL CRIMINAL DEFENSE CASES

 

Counsel has successfully helped clients avoid convictions in multiple federal investigations.

 

Union leader federally investigated.  NO CHARGES FILED as US Attorney's Office issues a letter indicating there would be no prosecution.

 

Client investigated by Secret Service for making threats against the president.  NO CHARGES FILED.

 

Client investigated by ATF in relation to an allegation of illegal sale of firearms.  Client offered pretrial diversion and avoids conviction.

Client acquitted of all charges in relation to bringing a firearm into a federal courthouse.

Client federally indicted after he unknowingly brought a briefcase containing a firearm in to the federal courthouse in Delaware.  After a trial in the United States District Court for the District of Delaware, Client was found not guilty of all charges as Counsel demonstrated that client was not aware when he entered the courthouse that his small firearm was within the briefcase.

Client investigated for fraud after search of client's home.  NO CRIMINAL CHARGES and no civil litigation filed.

 

Client investigated for alleged fraud against a corporation  Client retained Counsel immediately after Client's home was searched and multiple boxes of materials and digital devices were seized by the US Government.  Counsel was able to "create and maintain a path forward" that resulted in no criminal charges or civil litigation being instituted against client.

LAND USE CASES

Counsel successfully obtained a sign variance for client's property.

 

Client retained Counsel to obtain sign variance for a property in which previous owners were twice previously completely rejected by the New Castle County Board of Adjustment.  Counsel was able to obtain 80% of the square footage requested for the signage in the application.

New Castle County agrees to major reduction of Client's sewer bills.

 

In an unprecedented type of matter, Counsel was able to obtain $132,230.70 reduction of Client's sewer bills as New Castle County agreed that a water leak led to excessive billing.

Client obtains relief from the New Castle County Board of Adjustment to continue commercial activities on property.

 

Complaints were filed against Client's property and Client was issued citations for being out of compliance.  After a contested hearing in which the complaining property owner provided testimony, the New Castle County Board of Adjustment granted complete relief imposing minimal conditions which allowed Client to continue his commercial activities on the property.

Client builds apartment complex on small lot

 

Counsel was retained to provide due diligence in relation to the building of an apartment complex on a rather small 0.19 acre lot.  Client was able to build a 14 unit apartment complex on the lot. 

TRADEMARK INFRINGEMENT

Counsel successfully avoids possible trademark infringement litigation against client.

Local business received notice from legal counsel of a multi-national corporation of trademark infringement and was seeking damages and cessation of use of the trademark.  Counsel negotiated, on behalf of client, a stipulated resolution in which client did not have pay any damages and only had to discontinue use of the trademark which included the destruction of a small amount of items used in client's business which bore the trademark.

STATE CRIMINAL DEFENSE CASES

 

*Disclaimer*: I no longer take on any trial level cases in State Court and will only perform direct appeals, post conviction review or habeas review of state court criminal cases.  I will only represent someone with a sexual offense such as rape, after I conduct an investigation with my private investigator in which the investigator and I and my staff all believe that a crime has not occurred.

Client acquitted of Rape First Degree

Client was indicted on Rape in the First Degree which carried a 15 year minimum mandatory sentence.  After a jury trial, Client was acquitted of first degree rape and was only convicted of a class A misdemeanor which was only punishable up to one year of incarceration.

 

Client acquitted of Rape in the Second Degree.

 

Client was indicted on Rape in the Second Degree.  After a jury trial in the Delaware Superior Court, Client was found not guilty of all charges.

 

Client acquitted of First Degree Murder.

 

Client faced a life sentence for the indicated charge of Murder in the First Degree.  After a jury trial, Client was acquitted of first degree murder and unlawfully being in possession of a firearm and was only found guilty of the lesser included offenses of Attempted Assault Second Degree and Conspiracy Second Degree and only received a 4 year sentence of incarceration.

Client's first degree murder charges dismissed by the Delaware Superior Court.

 

Client faced spending the rest of his life in prison for the indicated charge of Murder in the First Degree.  After incredibly involved and protracted pre-trial litigation, the Delaware Superior Court dismissed the indictment and all charges agreeing with the Defense's argument that the State violated the Interstate Agreement on Detainers.

Client's sentence overturned due to ineffective assistance of counsel.

 

Counsel represented client during his postconviction proceedings, not during his trial.  On appeal from the denial of client's postconviction motion, the Delaware Supreme Court overturned the Superior Court agreeing with Counsel's argument that sentencing counsel was ineffective for failing to prepare himself and his client for the sentencing hearing.

Client's conviction overturned on appeal

 

Counsel represented client during his postconviction proceedings, not during his trial..  On appeal from the denial of client's postconviction motion, the Delaware Supreme Court overturned the Superior Court agreeing with Counsel argument that trial counsel was ineffective for failing to request a jury instruction on a lesser-included offense.
